Et tu, Hallmark?

paris hilton, who as she keeps insisting is "a nice person," as she herself has maintained and insisted almost exclusive of any other utterance since she went to jail, is entitled to lose her niceness every once in a while and i applaud her desire for justice from Hallmark Cards. I am sure her wrath stems from her depiction as a waitress, or in other words, as someone with a job. nice people do not have jobs, and paris hilton is a nice person. these ads make a mockery of her very existence, which is "existence without effort." handing a plate of breakfast to a customer is effort. the card also makes a mockery of her vocabulary, which consists of the two words "that's hot." she is not speaking in terms of temperature as the card suggests, she is speaking in more of a metaphysical, aesthetic, libidinous venue. these card cheapen her and i take her side in this fight.

She's probably got a case on unauthorized use of her image. If they'd done a caricature of her face rather than a photo it would be a lot less clear cut, but they're making money from her image without permission (and obviously without paying her). It's one thing for you or I to put her picture in our blogs - fair use and all - but this is legally different as every estate of every dead movie star knows.

Yes, it was a big deal for iBooks to use Bogart's image on the cover of the book I did for them.
